A. Misdemeanors. All crimes for which no penalty is specifically provided shall be classified as misdemeanors and shall be punished by a fine not to exceed one thousand dollars, or imprisonment for up to ninety days in jail, or by both such fine and imprisonment, unless the penalty for violation of a comparable state criminal statute shall provide for some other penalty, in which case the penalty provided by state law shall be imposed.

B. Gross Misdemeanors. All crimes classified as gross misdemeanors shall be punishable by a fine not to exceed five thousand dollars or imprisonment for up to three hundred sixty-four days in jail, or by both such fine and imprisonment, unless the penalty for violation of a comparable state criminal statute shall provide for some other penalty, in which case the penalty provided by state law shall be imposed.

C. Civil Penalty. Unless otherwise indicated, all violations of the Algona Municipal Code designated as civil infractions shall be punished by a civil penalty equal to the maximum penalty under state law for a class 1 civil infraction set forth in RCW 7.80.120 as currently enacted and hereafter amended. Proof of violation of civil infractions shall be by a preponderance of the evidence. Civil infractions may be heard before a duly appointed municipal court judge. Traffic infractions provided for in Chapter 308-330 WAC are specifically excluded for this chapter. (Ord. 1081-13 § 24; Ord. 1064-12 § 1; Ord. 834 § 1, 1997; Ord. 388 § 1(A), 1980).
