A. Enforcement – City Planner. The city planner, or his/her designee, shall be charged with the responsibility of enforcing the provisions of this title or any conditions properly imposed by a public official, the hearing examiner, the planning commission or the city council pursuant to this title. In addition to any remedy provided for in this chapter, the city planner, or his/her designee, may issue a stop work order whenever a violation of this title will materially impair the city planner’s, or his/her designee’s, ability to secure compliance, or when a violation of this title threatens the health, safety, or welfare of any member of the public or occupants of the property. The stop work order shall contain substantially the same information as for a notice of civil infraction and may be appended to, or incorporate by reference, a notice of infraction or notice of violation. In addition to any other methods of service, notice of the stop work order shall be deemed served upon posting of the notice, and shall be effective upon service. “Posting” shall mean posting a copy of the notice in a conspicuous place on the property, with at least one copy of such notice placed at the entryway to the property or structure, if an entryway exists, or other conspicuous place on the property. “The property” shall mean the property, or any part thereof, that is the subject of an application pursuant to this title.

B. General. It is a violation of this title for a person to divide, segregate, sell, or transfer, or offer to sell or transfer, real property in violation of this title. It is a violation of this title to do any other thing with respect to a lot, tract, parcel, or property in the city that violates this title or violates a plat, short plat, boundary line or lot consolidation restriction imposed by the city, or violates an order, including a stop work order, issued pursuant to this title.

C. Enforcement; Civil Infraction. Except as otherwise provided in this title, in addition to or as an alternative to any other penalty provided in this title or by law, no person shall violate or fail to comply with this title. A violation of or failure to comply with this title is a Class 1 civil infraction, pursuant to Chapter 7.80 RCW, and punishable by a fine of two hundred fifty dollars. Each day such violation continues shall be considered a separate violation and punishable as such.

D. Enforcement; Civil Violation. Except as otherwise provided in this title, in addition to or as an alternative to any other penalty provided in this title or by law, no person shall violate or fail to comply with this title. A violation of or failure to comply with this title is a civil violation pursuant to Chapter 1.24 and punishable by a fine as set forth therein. Each day such violation continues shall be considered a separate violation and punishable as such.

E. Enforcement; Criminal Penalty. Except as otherwise provided in this title, in addition to or as an alternative to any other penalty provided in this title or by law, a person convicted of a violation of this title is guilty of a gross misdemeanor and subject to the penalties of Chapter 1.24. Upon conviction a person may also be ordered to abate, discontinue, or correct a violation of this title. Each day such offense continues shall be considered a separate offense and punishable as such.

F. Other Lawful Remedies. Nothing in this section shall limit the right of the city to pursue other lawful criminal, civil, or equitable remedies to abate, discontinue, or correct violations of this title.

G. Any person who violates any provision of this chapter relating to the sale, offer for sale, lease or transfer of any lot is guilty of a gross misdemeanor and subject to the penalties of Chapter 1.24. Each sale, offer for sale, lease or transfer of each separate lot in violation of any provision of this chapter shall be deemed a separate and distinct offense. In addition to these criminal sanctions, the city shall have the right to bring an action to restrain and enjoin any subdivision, sale or transfer, compel compliance with the provisions of this chapter and obtain other injunctive relief. The costs of such action shall be paid by the violator and shall include the city attorney’s fees.

H. In addition to any other penalties set forth herein, the penalties, remedies, injunctions, and other legal sanctions necessary for the enforcement of this title shall be governed by RCW 58.17.200, 58.17.210, 58.17.220, 58.17.230, 58.17.300, and 58.17.320, which are adopted herein by reference as currently adopted or hereafter amended. Injunctive remedies shall be available for enforcement of all chapters in this title. (Ord. 1016-08 § 2).
