A. The fire marshal shall be responsible for the strict observance and rigid enforcement of all laws, resolutions and regulations pertaining to fire safety in the city.

B. The fire marshal shall be assisted in the discharge of his duties by such assistants, fire prevention inspectors and by the utility superintendent.

C. The fire marshal shall supervise and direct the activities in the city in a manner that will best serve the interest, and assure the safety of persons and property within the city.

D. The service of the fire marshal need not comply with the normal working schedule of the firefighting force, but shall be determined by the mayor or police chief or utility superintendent, as the needs of the service may require.

E. The fire marshal shall be subject to duty in the case of greater alarms, fires of suspicious origin or other emergencies, as directed by the mayor or other member lawfully serving in that capacity.

F. The fire marshal or designated arson investigator shall be responsible for the efficient investigation of all fires of suspicious origin, he shall sign a complaint and cooperate in the prosecution of anyone suspected of arson, or the violation of fire safety regulations, where such actions are justified by the competent evidence of testimony of witnesses.

G. The fire marshal shall recommend to the mayor for appropriate action by the city council, legislation required for the proper control of hazardous materials and processes in the city.

H. The fire marshal shall be responsible for the regular and frequent inspections of industrial and commercial occupancies.

I. The fire marshal shall prescribe regulations for the safe handling, storage, use or transportation of materials considered hazardous to life or property in the city.

J. The fire marshal shall be empowered to issue permits, or to pass on applications for permits, on all matters constituting a fire hazard, or in any way related to fire safety, as related to the application of the city fire code.

K. The fire marshal shall cause such details of personnel to places of public assemblage as may be required to provide adequate policing and assure the public safety.

L. The fire marshal shall, through direction and supervision, earnestly strive to achieve equal and uniform application of fire safety regulations through the city.

M. Within the limits of efficient administration, the fire marshal shall strive to coordinate all activities of the fire prevention bureau with those of the firefighting division, and shall extend every effort in effecting the maximum cooperation in all matters related to fire safety.

N. The fire marshal shall conduct a continuing program of public education in fire safety, and shall cooperate with civilian organizations in fire prevention programs, within the limits of time and budget considerations.

O. The fire marshal shall maintain accurate and complete records of all activities of the fire prevention bureau, he shall compile fire statistics, and prepare monthly and annual reports on the fires, and fire-loss experience of the city. (Ord. 543 § 3, 1985).
