The city attorney shall be compensated by a fixed monthly retainer and by compensation for special added services; the city prosecutor shall be compensated by a fixed monthly retainer:

A. In the case of the office of city attorney and the office of city prosecutor, whether the functions are combined or performed by one individual or separated and performed by separate individuals, a fixed monthly retainer shall be such amount as may be fixed by the city council from time to time in the annual budget adopted by a vote of the council and recorded in the budget ordinance. Such retainer shall constitute payment to the city prosecutor for attendance at all sessions of the municipal/district court, together with such preparation and related duties as may be necessary to the professional representation of the city, before the courts of the state. Such retainer shall constitute payment to the city attorney for attendance at city council meetings and such other city business not covered by a special services contract.

B. A yearly contract shall be negotiated between the city attorney and the city prosecutor; the contract between the city and the city attorney shall define special services and to cover expenses for same. (Ord. 619 § 5, 1988; Ord. 376 § 4, 1980).
