A. Established. There is created and established a special fund to be known as the “police forfeiture fund” into which all moneys and proceeds from the sale of property seized during drug investigations and forfeited pursuant to Chapter 69.50 RCW and all other applicable state laws shall be deposited after amounts are deducted in accordance with state laws.

B. Purposes – Expenditures. This fund has been established for the purpose of accumulating funds for expansion or improvement of law enforcement services including drug enforcement needs, drug awareness educational purposes and the purchase, lease and maintenance of equipment and other items necessary for drug enforcement by the police department. The moneys deposited in the police forfeiture fund shall be expended only for such purposes and for no other purpose when appropriated by the city council and shall not supplant preexisting funding sources.

C. Unexpended Funds. Any unexpended funds remaining in the police forfeiture fund at the end of any budget year shall not be transferred to the general fund or otherwise lapse, rather such unexpended funds shall be carried forward from year to year until expended for the purposes set forth in subsection B of this section.

D. Sources of Funding for the Police Forfeiture Fund. Currency seized pursuant to Chapter 69.50 RCW, Uniform Controlled Substances Act, as that statute currently exists or may hereafter be amended, or by city ordinance, after forfeiture is so ordered by a hearing officer or judge of a municipal, district, or superior court, shall be deposited directly into the police forfeiture fund when it is no longer of evidentiary value. Currency seized, which is not contested, shall be ordered forfeited by the city hearing officer and deposited directly into the police forfeiture fund. The proceeds of sales of property authorized by Chapter 69.50 RCW, as that statute currently exists or may hereafter be amended, or by city ordinance, shall be deposited directly into the police forfeiture fund.
