It is unlawful for any person to use, smoke or light cigarettes, vapor electronic cigarettes, cigars or pipes of any kind, including but not limited to hookah pipes, tobacco products, including but not limited to chewing tobacco, liquid nicotine, consumable nicotine or other smoking material in any city of Algona park.

Signs prohibiting smoking and declaring city parks to be tobacco-free areas shall be posted in appropriate locations.

For the purposes of this section, a “city of Algona park” means any city property identified as a “park” on Figure 2-7, entitled “Parks & Open Space,” of the city of Algona comprehensive plan, as currently in effect or as amended, or any city property identified as a city “park” in a city of Algona ordinance.

For the purposes of this section, “smoke” or “smoking” means the carrying, holding or smoking of any kind of lighted pipe, cigar, cigarette or any other lighted smoking equipment.

For the purposes of this section, “electronic cigarette,” also called “e-cigarette,” means an electronic device usually composed of a mouthpiece, a heating element or atomizer, a battery, and electronic circuits that provide a gas derived from liquid nicotine and/or other substances, which is inhaled by the user to simulate smoking. The term includes such devices, regardless of the details of the product appearance or marketed name, generally manufactured to resemble cigarettes, cigars, pipes or other smoking devices.

For the purposes of this section, “liquid nicotine” means any liquid product composed either in whole or in part of nicotine, proprylene glycol or other similar substances and manufactured for use with e-cigarettes, vaporizers or other devices to be converted into a gas for inhaling.

Any person violating any provision of this section shall be guilty of a misdemeanor and shall be punished by a fine not to exceed one thousand dollars, or by imprisonment in jail for a term not to exceed ninety days, or by both such fine and imprisonment. The monetary penalties for first, second, and subsequent violations of this section shall be as follows:
