A. Exclusive Use. Groups, who wish to use all or a portion of any park, playground or other recreational areas at the exclusion of the remainder of the public, must be granted permission from the city council to do so and may be charged a fee for such exclusive usage.

B. Covered Facilities. For purposes of this section, “covered facility” shall mean the public portions of any covered structure in any city park regardless of whether or not such structure is enclosed, in whole or in part.

C. Policies and Procedures. Use of covered facilities shall be subject to policies and procedures established by the city council that are not inconsistent with this chapter.

D. Covered Facilities Use. Covered facilities will be available for use on a first come, first served basis; provided, that the city reserves the right to reserve a covered facility in the event that it is needed for an activity or event for governmental purposes, including, by way of example and not limitation, scheduling of a special or emergency meeting of the city council or planning commission. The city reserves the right to, without recourse to the city, close a covered facility in the event that, in the sole judgment of the mayor, public works director, police chief, or city clerk or his/her designee, it becomes unsafe for use, requires emergency maintenance to render the facility safe, or otherwise requires unplanned maintenance that, taking into consideration cost and availability of resources, cannot reasonably be performed at another time.

E. Administration. The city clerk, or his/her designee, is authorized to implement policies and procedures established by the city council for the use of covered facilities that are consistent with this chapter. The city clerk, or his/her designee, shall administer this chapter and the policies and procedures established by the city council. Use of covered shelters by the city of Algona shall have priority over all other uses. (Ord. 1021-09 § 2; Ord. 1009-08 § 1).
