A violation of this chapter is a class 1 civil infraction. The civil infraction penalty for a first violation of this chapter within a one-year period shall be seventy-five dollars; for a second violation of this chapter within a one-year period, the penalty shall be one hundred fifty dollars; and for a third or subsequent violation of this chapter within a one-year period, the penalty shall be the maximum penalty under state law for a class 1 civil infraction set forth in RCW 7.80.120 as currently enacted and hereafter amended. For purposes of this section, a one-year period is defined herein as any violation occurring within twelve months from the date of the first violation. Proof of violation shall be by a preponderance of the evidence. Contested civil infractions may be heard before the duly appointed municipal court judge. (Ord. 1063-12 § 1; Ord. 832 § 1, 1997).
