For a police response to any false alarm, the following penalties shall apply:

A. For a police response to premises at which no other false alarm has occurred within the preceding six-month period, hereinafter referred to as a “first response”, no fine shall be assessed, but the person having such a burglary and/or robbery alarm shall, within three working days after notice to do so, make a written report to the chief of police or his designee on forms prescribed by the police department setting forth the cause of the false alarm, the corrective action taken, whether such alarm has been inspected by an authorized service persons, and any other information as the chief of police or his designee may reasonably require in order to determine the cause of such false alarm and corrective action necessary.

B. For any police response to a false alarm at a premises within six months after a first response, a fine of one hundred dollars shall be assessed, and a written report shall be required as for a first response, and the chief or his designee shall be authorized to inspect or cause to be inspected the alarm system at such premises, prescribe necessary corrective action, and shall give notice to the person having such alarm system or the conditions and the requirements of this section.

C. For any police response to a second false alarm as set forth in subsection (B) of this section, the alarm user, hereinafter referred to as “alarm responder,” shall be required to respond to the premises within a reasonable amount of time and shall notify the Algona police of the estimated time of arrival. Failure to respond within a reasonable amount of time after the Algona police department has been notified that there has been a false alarm shall result in the doubling of the fine referenced above to two hundred dollars.

D. All fines shall be paid within seven calendar days after written notification by the police department. Said notification shall be sent via certified mail, return receipt requested. If repeated alarms are the result of failure to take necessary precautions or corrective action by the owner or occupant of the premises, or if the chief of police determines that the alarm is defective, or if the owner or occupant fails to pay any fine required in this chapter, the chief of police may order the disconnection of the alarm system, or decline to respond to future alarms until the fault is corrected. It shall be a violation of this chapter to reconnect the alarm system without approval of the chief of police. (Ord. 836 § 1, 1997).
