Prior to the obtaining of permit from the city granting the right to conduct a surface mining operation within the city limits, the following conditions must be met:

A. An application must be presented to the city clerk/treasurer containing the following information:

1. A legal description of the site of mining operation;

2. Notarized document or documents or copy thereof giving permission of all property owners for this use of such property if property is owned by other than applicant or applicants;

3. Copy of title or other proof of ownership;

4. A brief statement giving reason for request, i.e., desiring to remove gravel.

B. The proposed site must comply with the land use requirements of Title 22.

C. Applicant must comply with pertinent SEPA guidelines more expressly WAC 197-10-010 through 197-10-910 and with Chapter 16.04.

D. All laws of the state pertaining to surface mining must be adhered to. (Ord. 306 § 2, 1976).
